1. Definitions

In these Terms and Conditions, the following words carry the meanings set out below:

"Agreement"
means these Terms and Conditions together with any engagement letter, service proposal, or written instruction agreed between Seri Pusaka and a Client.
"We", "Us", "Our", "Seri Pusaka"
refers to Seri Pusaka, a legal services practice operating from Suite 15-2, No. 73, Jalan Kuching, 51200 Kuala Lumpur, Wilayah Persekutuan, Malaysia.
"Client", "You", "Your"
refers to any individual or family who accesses this website or engages Seri Pusaka for professional services.
"Services"
means the inheritance and estate planning legal services offered by Seri Pusaka, including Heritage Consultation, Will and Wasiat Drafting Engagement, and the Generational Estate Programme.
"Website"
means the pages accessible at seriopusaka.live and any associated sub-pages or microsites operated by Seri Pusaka.
"Content"
refers to all text, images, documents, templates, and other materials published on the Website or shared with Clients in the course of an engagement.

2. Acceptance of Terms

By accessing or using this Website, or by engaging Seri Pusaka for any Service, you confirm that:

  • You have read and understood these Terms and Conditions in their entirety;
  • You are at least 18 years of age or have attained the age of majority under Malaysian law;
  • You have the legal capacity to enter into a binding agreement; and
  • You accept these Terms as binding on each occasion you use the Website or commission a Service.

If you do not accept these Terms, please discontinue your use of the Website. We are content to answer questions about any provision before you proceed.

3. Service Description

Seri Pusaka provides professional legal services focused on estate planning, will and wasiat drafting, and multi-generational inheritance arrangements for individuals and families in Malaysia. The three principal services are as follows:

Heritage Consultation (MYR 1,170)

A measured first consultation that includes advance document review, an unhurried in-person or written conversation, and a written summary of the matters raised. No further engagement is expected unless the Client chooses to proceed.

Will and Wasiat Drafting Engagement (MYR 3,260)

A considered drafting engagement for a civil will or wasiat document, together with any accompanying letter of wishes. The engagement proceeds at a pace that allows time for family discussions between drafts. Two rounds of revision are included.

Generational Estate Programme (MYR 6,610)

A long-form programme beginning with a private family conference and the preparation of a written estate map. Work proceeds at quarterly checkpoints, with family members encouraged to engage at their own pace between phases.

The scope of each Service is confirmed in writing at the commencement of each engagement. Services are available to individuals ordinarily resident in or with estate assets situated in Malaysia.

4. Your Responsibilities

To allow us to serve you properly, we ask that you:

  • Provide accurate and complete information when contacting us or during the course of an engagement;
  • Inform us promptly of any material change in your circumstances that may affect the scope of work;
  • Review and respond to draft documents within a reasonable period;
  • Use the Website only for lawful purposes consistent with these Terms;
  • Refrain from transmitting any material that is unlawful, defamatory, or harmful to others through the Website's contact form.

We kindly ask that communication with our team be conducted with the same consideration and respect that we extend in return.

5. Intellectual Property

All Content on this Website — including written text, design elements, documents, and templates — is owned by or licensed to Seri Pusaka and is protected under Malaysian copyright law and, where applicable, international intellectual property conventions.

You are granted a limited, non-exclusive licence to access and view the Website for personal, non-commercial purposes. This licence does not permit you to:

  • Reproduce, distribute, or republish any Content without our written consent;
  • Use any Content for commercial purposes or in a manner that competes with our Services;
  • Remove or alter any copyright notice or attribution appearing on the Website.

Documents prepared by Seri Pusaka during an engagement remain the intellectual property of the firm until all fees have been settled in full, at which point ownership of the final documents passes to the Client.

6. Fees & Payment

Fees are quoted in Malaysian Ringgit (MYR) and are as stated in the service description or confirmed in a written engagement letter. All applicable taxes are the Client's responsibility unless otherwise stated in writing.

Payment terms are confirmed in writing at the commencement of each engagement. We typically request a deposit prior to commencing substantive work, with the balance payable upon delivery of the final document.

Regarding refunds:

  • Where work has not yet commenced, deposits may be refunded at our discretion, less any reasonable administrative costs incurred;
  • Where substantive work has been performed, fees for completed work are not refundable;
  • In the event of a dispute over fees, we invite the Client to write to us at [email protected] before pursuing any formal process.

7. Engagement Terms

Each engagement is governed by a written engagement letter that specifies the scope of work, timeline, and fee arrangement. In the event of any conflict between these Terms and an engagement letter, the engagement letter shall prevail in relation to the specific matter it covers.

We will take reasonable steps to deliver work within agreed timelines; however, timing may be affected by the pace of family discussions, the availability of documents, or other circumstances outside our control. We will communicate any anticipated delays in writing.

Changes to the scope of an engagement require written agreement from both parties before additional work is undertaken.

8. Disclaimers

The information on this Website is provided for general information purposes and does not constitute legal advice. Reading materials on the Website does not establish a solicitor-client relationship.

While we take care to ensure that the Website's content is accurate and current, we do not represent that it is complete, up to date at all times, or applicable to any specific family or legal situation. Clients should seek written advice from a qualified legal practitioner in relation to their individual circumstances.

The Website is provided on an "as available" basis. We do not represent that the Website will be free from interruption, error, or omission at all times.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Seri Pusaka's liability to any Client for any claim arising from the use of the Website or the provision of Services shall not exceed the total fees paid by that Client for the relevant engagement.

We shall not be liable for any indirect, consequential, or special loss, including loss of opportunity, loss of anticipated benefit, or any claim arising from the acts or omissions of third parties.

Nothing in these Terms shall limit liability for fraud, gross negligence, or any matter that cannot lawfully be excluded under Malaysian law, including the Consumer Protection Act 1999 where applicable.

10. Indemnification

You agree to indemnify and hold Seri Pusaka, its principals, and associates harmless from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Website, or any false or misleading information you provide in the course of an engagement.

11. Termination

Either party may bring an engagement to a close by written notice. Where a Client chooses to discontinue an engagement, fees are payable for all work completed to that point, and any balance of the deposit not applied to completed work will be returned within 14 days.

We reserve the right to decline or discontinue an engagement where we determine that a conflict of interest exists, where information provided proves materially inaccurate, or where continued engagement would be contrary to professional obligations.

Provisions relating to intellectual property, confidentiality, payment for completed work, and dispute resolution survive the conclusion of any engagement.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with the Website or an engagement shall first be referred in writing to Seri Pusaka at [email protected], and we undertake to respond within 14 working days.

Where a dispute is not resolved informally, the parties agree to attempt resolution through mediation before commencing any formal legal proceedings. Mediation may be conducted through the Malaysian Mediation Centre or such other body as the parties agree in writing.

The courts of Malaysia, and where applicable the courts of Kuala Lumpur, shall have non-exclusive jurisdiction over any dispute not resolved through mediation.

13. General Provisions

Entire Agreement. These Terms, together with any applicable engagement letter, constitute the entire agreement between the parties in relation to their subject matter and replace any prior understanding or representation.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. A failure or delay in exercising any right under these Terms does not constitute a waiver of that right.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our obligations to a qualified successor practice with written notice to the Client.

Notices. Formal notices under these Terms should be sent in writing by post to our registered address or by email to [email protected].

14. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our Services, applicable law, or professional requirements. When we do so, we will update the "Last Updated" date at the top of this page.

Continuing to use the Website or to commission a Service after revised Terms have been published constitutes acceptance of the revised Terms. Where a change is material, we will endeavour to give reasonable notice by placing a notice on the Website's main page for a period of 30 days.
